Seller miss leads with description item is illegal?
I bought a self Defence item off a auction site. When I got the item it was a stun gun, which I knew was illegal but if I took it to police thought I would get charged with possesion, was watiing for amnesty. But police got the selller and my details on his pc, came to my house I handed it over told them and told them what I thought I was buying, I have been charged waiting for a report going to Fiscal to see if its going to court the receipt I got just says Self Defence Personal protection device. I have never been in trouble before and have a shotgun licence. Any advice or whats likely to happen to would be great thanks

- What did the listing make you believe you were buying? Can't you show the police a copy of the listing?
- Not sure what your question is here. The description "Self Defense Personal protection device" is appropriate and I do not feel is a misleading description for a stun gun. Stun guns are not illegal devices, they may be illegal to own where you live. It is your responsibility to ensure that you will comply with your local laws.
- If you have a shotgun licence why do you need a "defence item"That you didn't know what you were buying ha ha ha Ignorance is not a defence
- In the eyes of the law you were until confiscation found to be in the illegal possession of a banned item. If you had checked properly with the seller before the sale you may then have known what you were proposing to buy and at that time you would have had the choice to decline the offer. It is an offence which is punishable by imprisonment and as you say you are the holder of a shotgun licence i would be surprised if this has not yet been suspended by the police pending the outcome. I would hazard a guess that at the very least you will lose your gun licence and face a very heavy fine and that's only if you are able to convince the courts of any "good intentions" you may have had. With hindsight and at the very least if you were ? 'gullable' enough to have received this item and not been aware of what it really was then you should have gone to a police station without the item (in case you were stopped on the way) and explained to them and asked them then to go with you to your home to inspect the item and retreive it if they found it to be as you described. You only have yourself to blame and my only advice would be to get a good solicitor and when you appear in court tell them that you realise you have made a mistake and also have now come to realise just how serious a situation it is and ask them to consider giving you the benefit of doubt.
